住房和城鄉建設部關于落實建設單位工程質量首要責任的通知

住房和城鄉(xiang)建(jian)設部(bu)關于落(luo)實建(jian)設單位(wei)工(gong)程質量(liang)首(shou)要責任的通知(zhi)    

  

各(ge)省、自治區住(zhu)房(fang)和(he)城(cheng)鄉(xiang)(xiang)建(jian)設(she)廳,直轄市住(zhu)房(fang)和(he)城(cheng)鄉(xiang)(xiang)建(jian)設(she)(管)委,北京(jing)市規劃和(he)自然資源(yuan)委,新疆生產建(jian)設(she)兵(bing)團住(zhu)房(fang)和(he)城(cheng)鄉(xiang)(xiang)建(jian)設(she)局(ju):

  為(wei)貫徹落(luo)實《國務院辦(ban)(ban)(ban)公(gong)廳關于(yu)促進(jin)建(jian)(jian)筑業持續健康發展的(de)意(yi)見(jian)》(國辦(ban)(ban)(ban)發〔2017〕19號)和《國務院辦(ban)(ban)(ban)公(gong)廳轉(zhuan)發住(zhu)房城鄉(xiang)建(jian)(jian)設(she)部(bu)關于(yu)完(wan)善(shan)質(zhi)量保障(zhang)體系提(ti)升建(jian)(jian)筑工程(cheng)品(pin)質(zhi)指導(dao)意(yi)見(jian)的(de)通知(zhi)(zhi)》(國辦(ban)(ban)(ban)函〔2019〕92號)精神,依法(fa)界定并嚴格落(luo)實建(jian)(jian)設(she)單位(wei)工程(cheng)質(zhi)量首要(yao)責任,不斷提(ti)高房屋建(jian)(jian)筑和市政基礎設(she)施(shi)工程(cheng)質(zhi)量水平,現就有關事項通知(zhi)(zhi)如下:

  一、充分認(ren)識落實建設單位工程(cheng)質(zhi)量(liang)首要責任重(zhong)要意義

  黨的十八大以來,在以習近平同志為(wei)核心的黨中央堅強領導下,我(wo)國工(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)水平不(bu)(bu)斷提升,質(zhi)(zhi)量(liang)(liang)常見問題(ti)(ti)治理取得積(ji)極成效,工(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)事故得到有(you)效遏制。但我(wo)國工(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)責(ze)任(ren)體(ti)系(xi)尚不(bu)(bu)完善,特別(bie)是建設單(dan)位首要責(ze)任(ren)不(bu)(bu)明確、不(bu)(bu)落實,存(cun)在違(wei)反基本建設程(cheng)(cheng)序,任(ren)意趕工(gong)期、壓(ya)造價,拖欠(qian)工(gong)程(cheng)(cheng)款(kuan),不(bu)(bu)履行質(zhi)(zhi)量(liang)(liang)保修義務等問題(ti)(ti),嚴重影(ying)響(xiang)工(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)。

  建(jian)設(she)單位作為(wei)工(gong)(gong)(gong)程(cheng)建(jian)設(she)活(huo)(huo)動的(de)(de)總牽頭單位,承擔著重要(yao)的(de)(de)工(gong)(gong)(gong)程(cheng)質(zhi)(zhi)量管理(li)職責(ze)(ze)(ze),對保(bao)障工(gong)(gong)(gong)程(cheng)質(zhi)(zhi)量具(ju)有主導作用。各地(di)要(yao)充分認識嚴(yan)格落(luo)實建(jian)設(she)單位工(gong)(gong)(gong)程(cheng)質(zhi)(zhi)量首要(yao)責(ze)(ze)(ze)任的(de)(de)必要(yao)性(xing)和重要(yao)性(xing),進一步建(jian)立健(jian)全工(gong)(gong)(gong)程(cheng)質(zhi)(zhi)量責(ze)(ze)(ze)任體系,推動工(gong)(gong)(gong)程(cheng)質(zhi)(zhi)量提(ti)升,保(bao)障人(ren)(ren)民群眾生(sheng)命(ming)財產安全,不斷滿(man)足人(ren)(ren)民群眾對高品質(zhi)(zhi)工(gong)(gong)(gong)程(cheng)和美(mei)好生(sheng)活(huo)(huo)的(de)(de)需求。

  二、準確把握落實建設單位工程質(zhi)量首要責(ze)任內涵要求

  建(jian)設單位(wei)是工(gong)程質(zhi)(zhi)(zhi)量(liang)第一責任人(ren),依法(fa)(fa)對工(gong)程質(zhi)(zhi)(zhi)量(liang)承擔全(quan)(quan)面責任。對因(yin)工(gong)程質(zhi)(zhi)(zhi)量(liang)給工(gong)程所有權(quan)人(ren)、使用人(ren)或第三方造成(cheng)的損(sun)失,建(jian)設單位(wei)依法(fa)(fa)承擔賠償(chang)責任,有其他(ta)責任人(ren)的,可以向(xiang)其他(ta)責任人(ren)追償(chang)。建(jian)設單位(wei)要(yao)嚴格(ge)落實(shi)項目法(fa)(fa)人(ren)責任制(zhi),依法(fa)(fa)開工(gong)建(jian)設,全(quan)(quan)面履行(xing)管(guan)理(li)職責,確保工(gong)程質(zhi)(zhi)(zhi)量(liang)符合國家法(fa)(fa)律法(fa)(fa)規、工(gong)程建(jian)設強制(zhi)性(xing)標準和合同約定(ding)。

  (一)嚴格執(zhi)(zhi)行(xing)法(fa)定程(cheng)(cheng)序(xu)和發(fa)包(bao)(bao)制(zhi)度(du)。建(jian)設(she)單位要嚴格履行(xing)基本建(jian)設(she)程(cheng)(cheng)序(xu),禁止未取(qu)得(de)(de)(de)施工(gong)(gong)(gong)許可(ke)等建(jian)設(she)手續開(kai)工(gong)(gong)(gong)建(jian)設(she)。嚴格執(zhi)(zhi)行(xing)工(gong)(gong)(gong)程(cheng)(cheng)發(fa)包(bao)(bao)承包(bao)(bao)法(fa)規制(zhi)度(du),依法(fa)將工(gong)(gong)(gong)程(cheng)(cheng)發(fa)包(bao)(bao)給具備(bei)相(xiang)應(ying)(ying)資質的勘察、設(she)計、施工(gong)(gong)(gong)、監理(li)等單位,不得(de)(de)(de)肢解發(fa)包(bao)(bao)工(gong)(gong)(gong)程(cheng)(cheng)、違規指定分包(bao)(bao)單位,不得(de)(de)(de)直(zhi)接發(fa)包(bao)(bao)預拌(ban)混凝土等專(zhuan)業(ye)分包(bao)(bao)工(gong)(gong)(gong)程(cheng)(cheng),不得(de)(de)(de)指定按照(zhao)合同約定應(ying)(ying)由施工(gong)(gong)(gong)單位購入用于工(gong)(gong)(gong)程(cheng)(cheng)的裝配(pei)式建(jian)筑構配(pei)件、建(jian)筑材料(liao)和設(she)備(bei)或者指定生產廠、供應(ying)(ying)商。按規定提供與工(gong)(gong)(gong)程(cheng)(cheng)建(jian)設(she)有關的原(yuan)始資料(liao),并(bing)保證資料(liao)真(zhen)實(shi)、準確、齊全。

  (二)保證合(he)理工(gong)(gong)期和造價(jia)(jia)。建(jian)設單位(wei)(wei)要(yao)(yao)科(ke)學合(he)理確定工(gong)(gong)程(cheng)建(jian)設工(gong)(gong)期和造價(jia)(jia),嚴禁盲目趕工(gong)(gong)期、搶進度(du),不(bu)得迫使工(gong)(gong)程(cheng)其他參建(jian)單位(wei)(wei)簡化工(gong)(gong)序、降低質量標準。調整(zheng)(zheng)合(he)同約(yue)定的勘(kan)察、設計周期和施工(gong)(gong)工(gong)(gong)期的,應相(xiang)應調整(zheng)(zheng)相(xiang)關(guan)費用。因(yin)極端(duan)惡劣天氣等(deng)不(bu)可(ke)抗力以及重污染天氣、重大活(huo)動保障等(deng)原(yuan)因(yin)停(ting)工(gong)(gong)的,應給(gei)予合(he)理的工(gong)(gong)期補償。因(yin)材料、工(gong)(gong)程(cheng)設備價(jia)(jia)格變化等(deng)原(yuan)因(yin),需要(yao)(yao)調整(zheng)(zheng)合(he)同價(jia)(jia)款的,應按照合(he)同約(yue)定給(gei)予調整(zheng)(zheng)。落實優(you)質優(you)價(jia)(jia),鼓勵和支持工(gong)(gong)程(cheng)相(xiang)關(guan)參建(jian)單位(wei)(wei)創(chuang)建(jian)品質示范工(gong)(gong)程(cheng)。

  (三(san))推行施(shi)工(gong)(gong)(gong)過程(cheng)結(jie)算(suan)(suan)。建設(she)單位(wei)應有滿足(zu)施(shi)工(gong)(gong)(gong)所需的資(zi)金(jin)安排(pai),并向施(shi)工(gong)(gong)(gong)單位(wei)提供工(gong)(gong)(gong)程(cheng)款支(zhi)付(fu)擔保。建設(she)合(he)同應約定施(shi)工(gong)(gong)(gong)過程(cheng)結(jie)算(suan)(suan)周期(qi)(qi)、工(gong)(gong)(gong)程(cheng)進度(du)款結(jie)算(suan)(suan)辦法(fa)等內容。分部(bu)工(gong)(gong)(gong)程(cheng)驗收通過時(shi)原則上應同步完成工(gong)(gong)(gong)程(cheng)款結(jie)算(suan)(suan),不(bu)得以設(she)計變(bian)更(geng)、工(gong)(gong)(gong)程(cheng)洽商等理(li)由(you)變(bian)相拖延(yan)結(jie)算(suan)(suan)。政府(fu)投(tou)資(zi)工(gong)(gong)(gong)程(cheng)應當按(an)照國家有關規定確保資(zi)金(jin)按(an)時(shi)支(zhi)付(fu)到位(wei),不(bu)得以未完成審計作(zuo)為延(yan)期(qi)(qi)工(gong)(gong)(gong)程(cheng)款結(jie)算(suan)(suan)的理(li)由(you)。

  (四)全面履行(xing)質(zhi)(zhi)量管(guan)(guan)理(li)(li)(li)職(zhi)責。建(jian)設(she)(she)(she)(she)(she)單位(wei)要(yao)健全工(gong)程項(xiang)(xiang)目(mu)質(zhi)(zhi)量管(guan)(guan)理(li)(li)(li)體系,配備(bei)專(zhuan)職(zhi)人員并明(ming)確其(qi)質(zhi)(zhi)量管(guan)(guan)理(li)(li)(li)職(zhi)責,不具(ju)備(bei)條件的(de)(de)(de)可聘用專(zhuan)業機構或人員。加強對按(an)照合同約定自行(xing)采購的(de)(de)(de)建(jian)筑材(cai)料、構配件和設(she)(she)(she)(she)(she)備(bei)等的(de)(de)(de)質(zhi)(zhi)量管(guan)(guan)理(li)(li)(li),并承(cheng)擔相(xiang)應的(de)(de)(de)質(zhi)(zhi)量責任。不得明(ming)示(shi)或者暗示(shi)設(she)(she)(she)(she)(she)計、施工(gong)等單位(wei)違(wei)(wei)反工(gong)程建(jian)設(she)(she)(she)(she)(she)強制(zhi)性(xing)標(biao)準,禁止(zhi)以(yi)“優化設(she)(she)(she)(she)(she)計”等名義變相(xiang)違(wei)(wei)反工(gong)程建(jian)設(she)(she)(she)(she)(she)強制(zhi)性(xing)標(biao)準。嚴格質(zhi)(zhi)量檢(jian)(jian)測(ce)管(guan)(guan)理(li)(li)(li),按(an)時足額(e)支付檢(jian)(jian)測(ce)費用,不得違(wei)(wei)規減(jian)少(shao)依(yi)(yi)法應由建(jian)設(she)(she)(she)(she)(she)單位(wei)委托(tuo)的(de)(de)(de)檢(jian)(jian)測(ce)項(xiang)(xiang)目(mu)和數(shu)量,非建(jian)設(she)(she)(she)(she)(she)單位(wei)委托(tuo)的(de)(de)(de)檢(jian)(jian)測(ce)機構出具(ju)的(de)(de)(de)檢(jian)(jian)測(ce)報告不得作(zuo)為工(gong)程質(zhi)(zhi)量驗收依(yi)(yi)據。

  (五)嚴格工(gong)(gong)(gong)(gong)程(cheng)竣(jun)(jun)工(gong)(gong)(gong)(gong)驗(yan)(yan)收(shou)。建設(she)單位要在收(shou)到工(gong)(gong)(gong)(gong)程(cheng)竣(jun)(jun)工(gong)(gong)(gong)(gong)報告后及時組(zu)(zu)織(zhi)(zhi)竣(jun)(jun)工(gong)(gong)(gong)(gong)驗(yan)(yan)收(shou),重(zhong)大工(gong)(gong)(gong)(gong)程(cheng)或技術(shu)復雜工(gong)(gong)(gong)(gong)程(cheng)可邀請有關專家參加,未(wei)經驗(yan)(yan)收(shou)合格不得交付(fu)使用。住宅(zhai)工(gong)(gong)(gong)(gong)程(cheng)竣(jun)(jun)工(gong)(gong)(gong)(gong)驗(yan)(yan)收(shou)前,應(ying)組(zu)(zu)織(zhi)(zhi)施工(gong)(gong)(gong)(gong)、監(jian)理(li)等單位進行分戶驗(yan)(yan)收(shou),未(wei)組(zu)(zu)織(zhi)(zhi)分戶驗(yan)(yan)收(shou)或分戶驗(yan)(yan)收(shou)不合格,不得組(zu)(zu)織(zhi)(zhi)竣(jun)(jun)工(gong)(gong)(gong)(gong)驗(yan)(yan)收(shou)。加強(qiang)工(gong)(gong)(gong)(gong)程(cheng)竣(jun)(jun)工(gong)(gong)(gong)(gong)驗(yan)(yan)收(shou)資料管(guan)理(li),建立質(zhi)量終身責任(ren)信息(xi)檔案,落實竣(jun)(jun)工(gong)(gong)(gong)(gong)后永久性(xing)標牌(pai)制度,強(qiang)化質(zhi)量主體責任(ren)追溯(su)。

  三、切實加(jia)強住宅工程(cheng)質量管理

  各地要完善住(zhu)宅工(gong)程(cheng)質(zhi)量(liang)與市(shi)場監管(guan)聯動(dong)機制,督(du)促建(jian)設單位加強工(gong)程(cheng)質(zhi)量(liang)管(guan)理(li),嚴格履行質(zhi)量(liang)保(bao)修責(ze)任,推(tui)進質(zhi)量(liang)信息(xi)公開,切(qie)實保(bao)障商品住(zhu)房和保(bao)障性安居工(gong)程(cheng)等住(zhu)宅工(gong)程(cheng)質(zhi)量(liang)。

  (一)嚴格履行質量保修責(ze)任。建(jian)(jian)設單位(wei)要建(jian)(jian)立質量回訪(fang)和(he)質量投訴處理機制,及(ji)時(shi)組織處理保修范圍和(he)保修期限(xian)內出(chu)現的(de)質量問(wen)題,并對造(zao)成(cheng)的(de)損失先行賠償(chang)。建(jian)(jian)設單位(wei)對房(fang)屋所(suo)有(you)(you)權人的(de)質量保修期限(xian)自交付之日起計算,經維修合格的(de)部位(wei)可重新約定保修期限(xian)。房(fang)地產(chan)開發(fa)(fa)企(qi)業(ye)應(ying)當在商(shang)品房(fang)買賣(mai)合同中明確企(qi)業(ye)發(fa)(fa)生注銷情形下由其(qi)他房(fang)地產(chan)開發(fa)(fa)企(qi)業(ye)或具有(you)(you)承接能(neng)力的(de)法人承接質量保修責(ze)任。房(fang)地產(chan)開發(fa)(fa)企(qi)業(ye)未投保工程質量保險的(de),在申請(qing)住宅工程竣工驗(yan)收備(bei)案時(shi)應(ying)提供保修責(ze)任承接說明材(cai)料。

  (二)加(jia)強質(zhi)量(liang)信息(xi)公(gong)(gong)開(kai)。住宅工(gong)程開(kai)工(gong)前,建(jian)設單(dan)位要(yao)公(gong)(gong)開(kai)工(gong)程規劃許可、施工(gong)許可、工(gong)程結(jie)構形式、設計使(shi)用年限(xian)、主要(yao)建(jian)筑材料(liao)、參(can)建(jian)單(dan)位及項目(mu)負(fu)責(ze)(ze)人等信息(xi);交付使(shi)用前,應公(gong)(gong)開(kai)質(zhi)量(liang)承(cheng)諾書、工(gong)程竣工(gong)驗收(shou)(shou)報(bao)告(gao)、質(zhi)量(liang)保修負(fu)責(ze)(ze)人及聯系方(fang)式等信息(xi)。鼓勵組織(zhi)業主開(kai)放日(ri)、邀請業主代表(biao)和物業單(dan)位參(can)加(jia)分(fen)戶驗收(shou)(shou)。試行按套出具質(zhi)量(liang)合格證明文件。

  (三)加強(qiang)工(gong)程質量與房屋預(yu)售聯動管理。因(yin)發生違法違規行(xing)為、質量安全事故或(huo)重(zhong)大質量安全問(wen)題被責令全面(mian)停工(gong)的住宅工(gong)程,應(ying)暫停其(qi)項(xiang)目預(yu)售或(huo)房屋交易合(he)同網簽備案(an),待(dai)批(pi)準復工(gong)后方(fang)可恢復。

  (四)強化(hua)保障性(xing)(xing)安居(ju)工(gong)程(cheng)(cheng)質量(liang)管(guan)理。各地要制(zhi)定保障性(xing)(xing)安居(ju)工(gong)程(cheng)(cheng)設(she)(she)(she)計(ji)導則(ze),明確室(shi)內面(mian)積標(biao)準、層高、裝(zhuang)修設(she)(she)(she)計(ji)、綠化(hua)景觀(guan)等內容,探(tan)索建(jian)立(li)標(biao)準化(hua)設(she)(she)(she)計(ji)制(zhi)度,突(tu)出住(zhu)宅宜(yi)居(ju)屬性(xing)(xing)。政府投資保障性(xing)(xing)安居(ju)工(gong)程(cheng)(cheng)應完善建(jian)設(she)(she)(she)管(guan)理模(mo)式,帶(dai)頭推行工(gong)程(cheng)(cheng)總承包和(he)全過程(cheng)(cheng)工(gong)程(cheng)(cheng)咨(zi)詢。依法限(xian)制(zhi)有嚴重違約(yue)失信記錄的建(jian)設(she)(she)(she)單位參與建(jian)設(she)(she)(she)。

  四、全面(mian)加強對建設(she)單位(wei)的監督管理

  各地要(yao)建(jian)立健全(quan)建(jian)設單位落實首要(yao)責(ze)任(ren)監管(guan)機制,加大(da)政府監管(guan)力度(du),強化信用管(guan)理和(he)責(ze)任(ren)追究,切(qie)實激發建(jian)設單位主(zhu)動關心質(zhi)量(liang)、追求(qiu)質(zhi)量(liang)、創造質(zhi)量(liang)的(de)內(nei)生動力,確保(bao)建(jian)設單位首要(yao)責(ze)任(ren)落到實處。

  (一)強化監(jian)督檢查(cha)。建立日常巡查(cha)和差別化監(jian)管(guan)制(zhi)度,對(dui)質量(liang)(liang)責(ze)任落實不到位、有嚴重違(wei)法違(wei)規行為(wei)的(de)建設(she)單(dan)(dan)位,加(jia)大對(dui)其建設(she)項(xiang)目的(de)檢查(cha)頻(pin)次和力度,發(fa)現存(cun)在(zai)嚴重質量(liang)(liang)安(an)全問題(ti)的(de),堅(jian)決責(ze)令停工(gong)整改(gai)(gai)。督促建設(she)單(dan)(dan)位嚴格整改(gai)(gai)檢查(cha)中(zhong)發(fa)現的(de)質量(liang)(liang)問題(ti),整改(gai)(gai)報(bao)告經建設(she)單(dan)(dan)位項(xiang)目負責(ze)人(ren)簽字確認并加(jia)蓋(gai)單(dan)(dan)位公(gong)章后報(bao)工(gong)程所在(zai)地住(zhu)房(fang)和城鄉建設(she)主(zhu)(zhu)管(guan)部門。工(gong)程質量(liang)(liang)監(jian)督中(zhong)發(fa)現的(de)涉及主(zhu)(zhu)體結構安(an)全、主(zhu)(zhu)要(yao)(yao)使用功能的(de)質量(liang)(liang)問題(ti)和整改(gai)(gai)情況,要(yao)(yao)及時向社會公(gong)布(bu)。

  (二)強化信(xin)用(yong)管理。加(jia)快推進行(xing)業(ye)信(xin)用(yong)體系建(jian)(jian)(jian)設(she)(she),加(jia)強對(dui)建(jian)(jian)(jian)設(she)(she)單(dan)位及(ji)(ji)其法定代表人、項(xiang)目(mu)負責(ze)人質(zhi)量(liang)信(xin)用(yong)信(xin)息歸集(ji),及(ji)(ji)時向(xiang)社會公開相關(guan)行(xing)政(zheng)許可(ke)、行(xing)政(zheng)處罰、抽查檢查、質(zhi)量(liang)投訴(su)處理情況等信(xin)息,記入企業(ye)和(he)(he)(he)個人信(xin)用(yong)檔(dang)案,并與工程建(jian)(jian)(jian)設(she)(she)項(xiang)目(mu)審批管理系統等實現(xian)數據(ju)共享和(he)(he)(he)交換。充分運用(yong)守信(xin)激勵和(he)(he)(he)失信(xin)懲(cheng)戒手(shou)段,加(jia)大對(dui)守信(xin)建(jian)(jian)(jian)設(she)(she)單(dan)位的(de)(de)(de)(de)政(zheng)策支持和(he)(he)(he)失信(xin)建(jian)(jian)(jian)設(she)(she)單(dan)位的(de)(de)(de)(de)聯合懲(cheng)戒力度,營造(zao)“一處失信(xin),處處受罰”的(de)(de)(de)(de)良好信(xin)用(yong)環境(jing)。對(dui)實行(xing)告(gao)知承諾制的(de)(de)(de)(de)審批事項(xiang),發現(xian)建(jian)(jian)(jian)設(she)(she)單(dan)位承諾內(nei)容與實際(ji)不符的(de)(de)(de)(de),依(yi)法從(cong)嚴從(cong)重處理。

  (三)強(qiang)化(hua)責任(ren)追(zhui)究(jiu)。對建設單位(wei)違反相關(guan)法(fa)(fa)律(lv)法(fa)(fa)規及(ji)本通知(zhi)規定的(de)行為,要(yao)依(yi)法(fa)(fa)嚴肅查處(chu),并追(zhui)究(jiu)其法(fa)(fa)定代表人(ren)和(he)項目負責人(ren)的(de)責任(ren);涉嫌犯(fan)罪的(de),移送監察或司法(fa)(fa)機關(guan)依(yi)法(fa)(fa)追(zhui)究(jiu)刑事責任(ren)。對于政府投資項目,除依(yi)法(fa)(fa)追(zhui)究(jiu)相關(guan)責任(ren)人(ren)責任(ren)外,還要(yao)依(yi)據相關(guan)規定追(zhui)究(jiu)政府部門有關(guan)負責人(ren)的(de)領導責任(ren)。

  本通知適用(yong)于房(fang)屋建(jian)筑和市(shi)政基(ji)礎設(she)施工程(cheng)。各省、自(zi)治區、直轄市(shi)住房(fang)和城(cheng)鄉(xiang)建(jian)設(she)主管部門可根(gen)據本通知要求,制定(ding)具體辦法。
